1. Acceptance of Terms

By accessing or using GapIdeation ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

GapIdeation is a research and ideation platform that analyzes publicly available information about companies to identify market gaps and generate startup ideas. The Service aggregates data from public sources, applies AI analysis, and presents structured research outputs including evidence quotes, gap rankings, and opportunity assessments.

3. Account Registration

To access certain features, you must sign in using a third-party OAuth provider (GitHub or Google). By creating an account, you agree to:

  • Provide accurate information through your OAuth provider
  • Maintain the security of your account credentials
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Scrape, crawl, or extract data from the Service for unauthorized purposes
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to harass, defame, or harm any individual or organization
  • Redistribute or resell access to the Service without our written consent
  • Use automated systems or bots to access the Service beyond normal usage

5. Intellectual Property

5.1 Our Content

The Service, including its design, features, code, and branding, is owned by GapIdeation and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission.

5.2 Your Content

Reports, analyses, and exports you generate using the Service are yours to use. You retain ownership of any original work you create using our outputs. However, you acknowledge that analyses are generated from publicly available information and AI processing, and similar outputs may be generated for other users.

5.3 Third-Party Content

Evidence quotes displayed in the Service are short, fair-use excerpts from publicly available sources. Each quote includes attribution and a link to the original source. We do not claim ownership of third-party content.

6. AI-Generated Content

Analyses, gap assessments, and startup ideas generated by the Service are produced using artificial intelligence. You acknowledge that:

  • AI-generated outputs may contain inaccuracies or errors
  • Outputs are for informational and research purposes only
  • You should independently verify any information before making business decisions
  • We do not guarantee the accuracy, completeness, or viability of any generated startup idea
  • Similar or identical outputs may be generated for other users analyzing the same companies

7. API Keys and Third-Party Services

If you provide your own API keys for AI providers (Anthropic, OpenAI), you are responsible for compliance with those providers' terms of service and any costs incurred through their APIs. We are not responsible for charges from third-party API providers resulting from your use of the Service.

8. Fees and Payment

The Service may offer free and paid tiers. If you subscribe to a paid plan, you agree to pay all applicable fees. We reserve the right to change pricing with reasonable notice. Refunds are handled on a case-by-case basis.

9. Data and Evidence Sources

The Service aggregates publicly available information. We commit to:

  • Respecting robots.txt and site terms of service
  • Using official APIs when available (e.g., Reddit API)
  • Keeping quoted excerpts short and within fair-use guidelines
  • Always linking to original sources with proper attribution
  • Providing a "Remove source" mechanism for content owners who wish to opt out
  • Storing only the minimal text needed for context

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAPIDEATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless GapIdeation, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time. Provisions that by their nature should survive termination will survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
